Terms of Service

  1. Acceptance: When you purchase or use the SERVICE, you accept these Terms and Conditions (as they may be updated from time to time).
  2. Consent: You expressly consent to all such disclosures of identity and other information to us our agents and/or employees for the purposes of determining your identity and provisioning the SERVICE. You also expressly consent to use of this information by third parties as may be described in our privacy policy which is incorporated here by reference.
  3. Caution & Common Sense: It is expected that you will use caution and common sense when utilizing the SERVICE.
  4. Information: In consideration of use of our SERVICE, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by registration forms; and (b) to maintain and update this information to keep it true, accurate, current, and complete. If any information provided by you is untrue, inaccurate, not current or incomplete,   Virtuolink retains the right to deactivate your SERVICE and refuse any and all current or future use of the SERVICE.
  5. Permitted Use: You may use   Virtuolink for calls to be made from one or more countries to India and other international locations mentioned in the user guide. The information regarding the originations and destinations countries is provided on the website.
  6. Invoicing, Payment & Rates: If your SERVICE is pre-paid or pay as you go, you are expected to top up your credit balance by visiting our site to purchase online top up vouchers. No separate invoice for use will be raised by   Virtuolink for your usage. If you are a post-paid customer,   Virtuolink shall bill you every month for the usage made in the previous calendar month and rental for the subsequent month. This invoice shall be paid within 7 days from date thereof failing which   Virtuolink reserves the right to suspend the SERVICE to you without losing the right to proceed against you under the law for recovery of the overdue amounts. All overdue amounts carry an overdue charge and interest rates at 18% p.a. Rates for international calls may vary and are subject to change. Please call customer care for your specific rates, access codes, and country codes. Higher rates may apply for calls originating and terminating from mobile. For rate card please refer user guide. Telecommunications services may also be subject to fees and surcharges, including without limitation per call fees. These fees and/or surcharges are assessed at the time the call is made and are in addition to the rate per minute applicable to the call. By agreeing to purchase   Virtuolink, you agree to pay the rates, fees and surcharges in effect for that SERVICE at the time of use of the SERVICE.
  7. Call Rounding: Call length will be rounded off to whole minute increments unless otherwise specified. SIMs have no cash redemption value.
  8. Credits and Refunds:   Virtuolink will not provide credits/refunds for unused / partially used / lost SIMs and will not accept or return to you any unused / partially used SIMs for refunds. If you purchased your   Virtuolink at a retail store, there are no refunds unless the SERVICE is defective.
  9. Loss of SIM: The customer will be responsible for protecting their SIMs.   Virtuolink is not responsible for lost or stolen SIMs. The risk of loss of all SIMs purchased shall pass to customer immediately upon purchase and customer shall assume all risk of loss.   Virtuolink shall not be obligated to provide credits or refunds (in any form or amount) for lost or stolen SIMs, misused SIMSs, unauthorized or fraudulent use of SIMSs, or for SIMSs that have unused or expired minutes.
  10. Replacement of Damaged/Lost SIM:   Virtuolink may at its discretion replace any damaged or lost SIM upon your reporting the damage/loss of the SIM to   GSM   Mobile.   Virtuolink may charge a fee for this service. You agree to immediately inform   Virtuolink upon loss of your   Virtuolink SIM.
  11. Limitation or Denial of SERVICE:   Virtuolink may deny or limit use of the SERVICE for any lawful reason. Due to the portable nature of the SERVICE,   Virtuolink reserves the right to block, without notice, any SERVICE that   Virtuolink has reasons to believe to have been used, or that might be used, for fraudulent or illegal or anti national purposes.   Virtuolink may also intercept mobile calls for fraud avoidance.   Virtuolink will provide subsequent voice notification of such blocking or termination.   Virtuolink will unblock as soon as it determines it can do so without undue risk, and it may, upon request by you, assign a new Number to replace any that were deactivated.
  12. Force Majeur:   Virtuolink and its distributors and agents will not be liable for any failure of performance due to causes beyond its control, including, but not limited to, acts of God, fires, floods or other catastrophes, national emergencies, insurrections, riots or wars, strikes, lockouts, work stoppages or other labor difficulties, preemption of existing services in compliance with any law, order, regulation or other action of any governing authority or agency thereof.
  13. No Warranty:   Virtuolink and its distributors and retail agents make no express or implied representations or warranties about their services and disclaims any implied warranties, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose or use or non-infringement.   Virtuolink and its distributors and retail agents do not authorize anyone to make a warranty on behalf of   Virtuolink or any other telecommunication service provider and you may not rely on any statement of warranty as a warranty by   GSM   Mobile.
  14. Indemnification: You will indemnify, defend, and hold harmless   Virtuolink and its employees, distributors and retail agents against all claims of loss or damage arising from use of your SERVICE, including (a) allegations or claims for libel, slander, invasion of privacy, or infringement of copyright arising out of the material, data, information, or other content transmitted via the SERVICE, and (b) all other allegations and claims arising out of any intentional act or omission by you or others authorized by you to use the SERVICE.   Virtuolink disclaims all warranties and conditions, express, implied or statutory, including without limitation the implied warranties of title, merchantability, fitness for a particular purpose and non-infringement. In no event will   Virtuolink and its distributors and retail agents be liable for any indirect, special, incidental, consequential, exemplary, or punitive loss or damage of any kind whatsoever, including loss of profits or business.
  15. Right to Amend:   Virtuolink in its sole discretion without prior notice, may modify, amend and alter the Terms. No waiver of the Terms is valid. The Terms are binding upon you and   Virtuolink and your respective agents and heirs. If any part or provision of these Terms is finally determined to be invalid or unenforceable under applicable law by a court of competent jurisdiction, then that part or provision will be ineffective only to the extent of such invalidity or unenforceability, without in any way affecting the remaining part or provisions of these Terms.
  16. Governing Law and Jurisdiction: The Terms are governed by and construed and interpreted in accordance with USA Laws, without regard to conflict of law principles. All disputes vis a vis SERVICE and the matter incidental thereof will be subject to jurisdiction of Texas, USA.
